Potts Law Firm Asks Federal Panel to Consolidate Nationwide Artificial Intelligence Litigation
HOUSTON, Oct. 5, 2026 /PRNewswire/ -- The Potts Law Firm has asked the U.S. Judicial Panel on Multidistrict Litigation ("JPML") to centralize and consolidate the growing number of federal lawsuits arising from allegations that xAI's Grok artificial intelligence system generated sexually explicit images depicting minors.
Cases are currently pending in federal district courts across the country, involving overlapping factual and legal issues concerning Grok, xAI, and the development, design, safeguards, warnings, and oversight of the artificial intelligence system.
The motion asks the JPML to transfer the related cases to a single federal district court for coordinated pretrial proceedings. Centralization would allow the courts and the parties to address common issues efficiently, avoid potentially inconsistent rulings, and reduce duplicative discovery and motion practice.
"These cases present extraordinary questions about what happens when artificial intelligence is developed and deployed without adequate safeguards to prevent the creation of sexually abusive material depicting children," said Derek Potts, founder of the Potts Law Firm. "There are families across the country who are now being forced to confront the consequences of technology that should never have been capable of producing this type of material. Bringing these cases together will allow the courts to address the common issues in a coordinated manner and ensure that the victims and their families have a meaningful opportunity to be heard."
Potts added: "These cases share significant factual and legal questions concerning how artificial intelligence was designed, what safeguards were implemented, what the defendants knew about the risks associated with the technology, and what measures were—or were not—taken to prevent the generation of sexually explicit images depicting minors."
The litigation raises questions concerning the responsibilities of companies developing generative artificial intelligence, including their obligations to implement effective safeguards, respond to known risks, and prevent their technology from being used to generate sexually abusive material involving children.
The JPML will determine whether the requirements for multidistrict litigation are satisfied and, if so, where coordinated proceedings should be conducted.
The Potts Law Firm represents individuals and families pursuing claims arising from the alleged generation and dissemination of sexually explicit AI-generated images depicting minors and is continuing to investigate claims involving Grok and related entities.
The case is titled In Re: Artificial Intelligence Minor Sexual Exploitation Litigation, Case No. 1:26-P-49.
